AlphaLuma Terms of Use

Welcome to AlphaLuma. By downloading, installing, or using the AlphaLuma application (hereinafter referred to as the "App" or "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using AlphaLuma, you confirm that:

• You are at least 13 years of age (or the minimum age required in your jurisdiction)
• You have read, understood, and agree to be bound by these Terms
• You agree to comply with all applicable laws and regulations

If you are under 18 years of age, you must have your parent or legal guardian's consent to use this App.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal Apple device solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, or create derivative works of the App or its content
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App to any third party
• Use the App for any commercial purpose without our prior written consent
• Remove or alter any proprietary notices, labels, or marks in the App

3. User Accounts

To access certain features of the App, you may be required to sign in using Apple Sign-In. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately at sonyalphainfo@126.com if you suspect any unauthorized use of your account

We reserve the right to suspend or terminate your account at our discretion if we reasonably believe you have violated these Terms.

4. User-Generated Content

If the App allows you to create, upload, or share content (such as Creative Look recipes, photos, or recipe cards), you retain ownership of your content. By submitting content through the App, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, display, and distribute your content solely for the purpose of operating and improving the Service.

You represent and warrant that:

• You own or have the necessary rights to the content you submit
• Your content does not violate any third-party rights, including intellectual property rights or privacy rights
• Your content complies with these Terms and all applicable laws

We reserve the right to remove any content that violates these Terms or that we find objectionable, at our sole discretion.

5. Prohibited Conduct

You agree not to use the App to:

• Violate any applicable law or regulation
• Infringe upon the intellectual property rights of others
• Upload or transmit any content that is unlawful, defamatory, obscene, or harmful
• Attempt to gain unauthorized access to any part of the App or its related systems
• Interfere with or disrupt the integrity or performance of the App
• Use automated means to access, scrape, or collect data from the App
• Impersonate any person or entity

6. Intellectual Property

The App and all its content, features, and functionality — including but not limited to text, graphics, logos, icons, images, and software — are owned by us or our licensors and are protected by applicable intellectual property laws.

"AlphaLuma" and associated logos and marks are our trademarks. You may not use them without our prior written permission.

7. In-App Purchases and Subscriptions

The App offers optional paid features ("AlphaLuma Pro") through Apple's App Store. All purchases are processed by Apple. By making a purchase, you agree to Apple's Terms and Conditions for the App Store.

• Subscription fees are charged to your Apple ID account upon confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• To cancel, go to your Apple ID account settings in the iOS Settings app
• No refunds are provided for any unused portion of a subscription period, except as required by applicable law or Apple's refund policy

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or free of viruses or other harmful components
• Any defects or errors in the App will be corrected
• The results obtained from use of the App will be accurate or reliable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your use of the App.

11. Third-Party Services

The App may integrate or link to third-party services (such as Apple Sign-In, Firebase Analytics, Mixpanel, RevenueCat). Your use of such third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party services.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the App or by other means prior to the changes becoming effective. Your continued use of the App after such notice constitutes your acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, all licenses granted to you under these Terms will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved by mutual negotiation. If negotiation fails, disputes shall be submitted to the court with jurisdiction in the defendant's domicile.
